Booking Conditions
Reservations for self catering accommodation are accepted by
Duke's Apartments as owners and agents for the Owner of the
properties and are subject to the following terms and
conditions:

Circumstances beyond the
control of Duke's Apartments (Force Majeure).
Except where otherwise expressly stated in these conditions,
Duke's Apartments and the property owners shall not be liable,
jointly or individually, for any changes, cancellations,
effect on your holiday, loss or damage suffered by you or for
any failure by the accommodation providers to perform or
properly perform any of their respective obligations to you
which is due to any event(s) or circumstance(s) beyond the
reasonable control of the accommodation provider concerned
(referred to as 'force majeure' in these conditions). By
way of example, force majeure includes fire, flood,
exceptional weather conditions, epidemics, destruction, acts
of terrorism or damage of accommodation by any cause (other
than negligence of the accommodation provider) and all similar
situations.
No compensation, expenses, costs or other sums of any
description (including without limitation the cost of securing
alternative accommodation) will be payable in such
circumstances by either the accommodation owner or Duke's
Apartments.
Guest Expectations
Duke's Apartments is not responsible if the chosen accommodation does not meet the expected style required. Please view accommodation at our website www.Duke's Apartments.com prior to booking and call our office if you have any queries.
Appliances and Utilities
Duke's Apartments are not responsible for any failure of utilities, essential services and appliances. Please report any failures as soon as possible and every attempt will be made to contact the appropriate authorities or organise repairs.
However, immediate repair may be beyond our control.
No refund or discount will be deducted from tariffs for unusable appliances awaiting repair.
Our responsibility to you for your Booking
As we have our own properties, and act as a booking agent, we
have no liability for any of the accommodation arrangements
(including any shortcomings or defects with or in any
accommodation) and no liability for any illness, personal
injury, death, damage or loss of any kind, unless caused by
our negligence or that of any employee of ours (providing they
were at the time acting in the course of their employment). We
cannot accept any liability for any act(s) or omission(s) of
the accommodation providers or anyone representing, or
employed by, the accommodation providers. Please also refer to
Section 1 (Force Majeure) above. Any claim arising from your
stay in the accommodation and/or the act(s) and/or omission(s)
of the accommodation provider or any employee of the
accommodation provider must be brought against the
accommodation provider directly The accommodation provider
shall have no liability for any illness, personal injury,
death, damage or loss of any kind unless caused by the
accommodation provider's negligence or that of any employee
of the accommodation provider (providing they were at the time
acting in the course of their employment).
You must take all necessary steps to safeguard your personal
property. No liability is accepted by Duke's Apartments or the
accommodation provider in respect of damage to, or loss of,
such personal property except, in the case of the
accommodation provider, where the damage or loss is caused by
accommodation provider's negligence or that of any employee
of the accommodation provider (providing they were at the time
acting in the course of their employment) or, in the case of
Duke's Apartments, where the damage or loss is caused by the
negligence of Duke's Apartments or its employees (providing
they were at the time acting in the course of their
employment). For any claim made against us which does not
involve death, illness or injury, any liability we have is in
any event limited to that provided by the courts in the
jurisdiction of the state of Western Australia.
Booking Deposit
Generally full payment is required to confirm a booking. The only exception is if the booking is more than 6 months in advance when we may agree to take a deposit of 50%, with the balance due 8 weeks prior to arrival but this is at our discretion.
Cancellation
Policy
The payment for cancelled bookings is non-refundable, non-exchangeable and
non-transferable unless we receive another booking over the same dates at the same rate. When this happens we refund your payment minus an administration fee equivalent to 1 nights payment.
Check In / Check Out
Check in time is after 3.00 pm unless by prior arrangement.
Check out time is before 10.00 am. Should you wish to extend,
please contact us to confirm availability. A late check
out fee may apply.
Cleaning Service Fee
Our rate includes a standard cleaning charge to cover changing
linen and up to 2 hours
cleaning. If the apartment requires additional cleaning when
you depart, you will be charged at a rate of $40 an hour. As a
guide you can avoid this charge by following these steps:
- Remove used linen and place in bathroom.
- Wash
all dishes and return to the cupboards that they came
from.
- Take
all rubbish to the bins.
- Wipe down kitchen and clean grill.
- Put
all used towels in the bathroom.
- Ensure
food or dirt is not left on floor or walls.
Consumables
A basic supply of toilet paper is supplied. A convenience
store is located at 127 Wellington St . Alternatively a
supermarket is located in Hay St, near the corner of
Bennett St. Toiletries are not provided.
Description
The guest accepts that Duke's Apartments has described the
property to the best of its ability and will not be held
liable should the property be deemed unsuitable on arrival.
Governing Laws
The laws of the state of Western Australia, govern these terms
and conditions. You as a renter agree to submit to the
jurisdiction of the courts of Western Australia.
Guests
Property
All personal belongings, luggage, vehicles and other property
belonging to the Guest shall be the risk of the Guest at all
times and neither Duke's Apartments or the property owners
accept any responsibility for any loss or damage thereto.
Group Size
Under no circumstances may the number of persons residing at
the apartment exceed the maximum number of guests confirmed at
the time of booking. Should this condition not be adhered to,
additional charges will be incurred.
Insurance
You are strongly recommended to take out adequate holiday
insurance. It is your responsibility to check you have
adequate insurance cover. The insurance should cover, amongst
other things, the cost of cancellation by you, all medical
costs and the cost of assistance including return to your
point of origin, in the event of an accident or illness.
Keys
Keys will be available on the day of arrival unless otherwise
arranged. When you depart please turn off appliances, leave all sets of keys
on the dining room table, and ensure the door is locked.
Please note that if keys, and remote access devices, are lost
or not left in the apartment when you depart you will be
charged $200. This is to cover the replacement cost. There is a charge of $75 to open the door, for
you, if keys are locked inside the apartment whilst you
are still staying in the apartment.
Linen
Sheets, blankets, pillows, mattress protectors, towels, and
tea towels are provided in the apartments.
We provide quality bed linen in the apartments - please do
not allow massage oil to come in contact with the sheets.
The cost of replacing damaged linen will be charged to your account.
Method of Payment
We are pleased to accept the following methods of payment:
VISA, Mastercard, Bankcard.
Parking
Parking is provided for one car. Guests must only park cars in
the designated area for the apartment.
Security Bond
Prior to your departure from our properties a Security Bond will be preauthorised on your credit card. This will not be charged to you credit card unless you have incurred additional charges. Therefore your Credit Card must be valid and contain sufficient funds to cover the bond. Please ask when booking, how much bond will be held.
Power and Cooling/Heating
Charges for these services are included in the daily
tariff.
Rates and Tariff
Please note that our tariffs are subject to change and may
have a loading for public holidays and long weekends. Tariffs
will be confirmed on request for a quotation.
Smoking
All of our properties are non-smoking. Any costs incurred with
removing tobacco odours and damage will be deducted from your
bond. Suitable areas are provided to smoke outdoors at all
properties.
Swimming Pools
Swimming Pools are open during daylight hours. Swimming pools are available for
guest use only, visitors are not permitted to use the pool. Glass containers and food are not permitted in the
pool areas. The pool does not have a lifeguard and children
must be unless supervised by an adult. Please respect
the conditions of entry posted in the pool areas. Note: The pool at the Viscount Suite is due to be renovated later in 2008 or early 2009. This will cause some disruption to the pool area. Please let us know, when you book, if this will cause you problems.
Telephone
A phone is provided, for local calls, for your convenience.
Calls will be charged to your credit card at the standard
Telstra rate. Incoming calls are accepted at all times.
Your
Behaviour
When you book accommodation through Quinby Operations Pty Ltd,
trading as Duke's Apartments, you accept responsibility
for the proper conduct of yourself and your party during your
stay. The accommodation provider reserves the right at any
time to terminate your stay or that of any member of your
party due to your or their misconduct, where justified in
their reasonable opinion. Full cancellation charges will then
apply and no refund will be given. Furthermore, neither the
accommodation provider nor Quinby Operations Pty Ltd shall be
under any obligation whatsoever to pay compensation or meet
any costs or expenses you may occur as a result of your stay
being terminated. If your actions or those of any member of
your party cause damage to the accommodation in which you are
staying, you must fully reimburse the accommodation provider
for the cost of the damage before you end your stay. You must
also indemnify us against any claim (including legal costs)
made against us as a result.
